How to Pick the Right Criminal Defense Lawyer: 7 Questions to Ask

If you’re facing criminal charges, choosing the right lawyer is one of the most important decisions you’ll make. Not all lawyers are created equal, and not all of them will have your best interests at heart. Before you hire anyone, ask these seven questions:

1. Can They Guarantee a Result? 🚩

If a criminal defense lawyer guarantees you’ll win, run. No attorney can promise a dismissal, reduced charges, or a not-guilty verdict. If they do, they’re either lying or inexperienced. At Erin Bailey Law, the only guarantee we make is that we’ll fight like hell for you.

2. Do They Use Scare Tactics?

A good lawyer should make you feel calmer, not more anxious. If they spend the whole consultation trying to scare you into hiring them, that’s a red flag. You deserve a lawyer who will be honest about your situation while also helping you feel more in control.

3. What’s Included in Their Fee?

Are you paying one flat fee, or will you be charged extra for every motion filed and every court appearance? Some lawyers charge separately for trial, which can pressure you into taking a plea deal just to avoid extra costs. At Erin Bailey Law, we charge one upfront price—so you can make legal decisions based on your case, not your wallet.

4. How Will You Communicate?

Will you get a direct line to your lawyer, or will you have to go through a paralegal? Some firms make it impossible to talk to your attorney once you’ve paid. At Erin Bailey Law, all clients get Erin’s personal cell number—option to call or text.

5. Do They Actually Handle Criminal Cases?

Not all lawyers focus on criminal law. Your neighbor’s real estate attorney or your cousin’s corporate lawyer isn’t who you want defending your DUI. In South Carolina, attorneys can’t say they “specialize” in a specific area, but you can and should ask how much of their practice is dedicated to criminal defense.

6. Are They Local?

Laws, judges, and courtroom procedures vary from county to county. A local attorney knows the judges, prosecutors, and court staff, which can be a huge advantage in your case. In smaller towns like Georgetown, who your lawyer knows matters.

7. Do They Feel Like the Right Fit?

You need to trust your lawyer. If they make you feel uneasy, pressured, or just plain give you the icks, listen to that instinct. You’re trusting them with your future—make sure they’re someone you actually feel comfortable with.
